Sturgis Trademarks lawsuits Update. The lawsuit and counter lawsuit between Sturgis Motorcycle Rally Inc. (SMRI) – owner of several Sturgis and Black Hills Rally trademarks – and a group of businesses under the banner of “Concerned Citizens Of Sturgis”opposing these trademarks is still going on with first court dates scheduled in May postponed again. “Concerned Citizens Of Sturgis” attorney has requested sworn depositions of 2 members of SMRI (Jerry Berkowitz’s of “Hot Leathers/Good Sports” and Black Hills Harley-Davidson) who formally opposed and challenged the legality of any geographic location trademarks One can imagine that SMRI’s attorney find less risk for his client and has interest in postponing as long as possible any legal decision until after the 2012 Sturgis rally takes place. During this time, weighing in on the trademark dispute Secretary of State Jason Grant said that South Dakota law doesn’t permit registration of a trademark for a place name for exclusive use. Any trademark registration with a name of location can only be used in connection with additionally descriptive terms distinctive of the applicant’s goods or services.”  “This only could have take place at the federal level, because my office has and will continue to reject similar applications,” Grant said.

City Of Sturgis Facing Risk Of Deficit Because Of Motorcycle Rally. Increased costs to host the rally and decreased revenue is challenging the City Of Sturgis budget. So, actions have been taken to supplement income: an increase of vendor fees by 8 percent, leasing of various city properties during the rally such as city parks and reducing the 2012 formally voted operating budget by nearly $220,000. The City Manager Daniel Ainslie states that the citizens of Sturgis likely do not benefit or actually loose money from the rally. 2011’s rally, including sales tax, brought in $391,000 to the city, however the profits do not include the time spent by city staff, such as the finance office, attorney and human resources. According to the comprehensive plan, the city should work out a strategy to ensure that the city profits at least $1,000,000 from the rally. The city also plans building a new venue to attract a new younger audience interested in the rally for the next 10 to 15 years.

Johnson is now 66, about to celebrate 12 years at Tucker Rocky in October and prior spent 27 years in various management positions at PepsiCo in the area of supply chain and logistics. Tucker Rocky Distributing plans for a new recruit to be on board this fall. Tucker Rocky, based in Fort Worth, is a subsidiary of LDI Ltd., an Indianapolis-based investment and holding company, employs about 700 people and provides distribution services to more than 10,000 motorcycle dealers in North America.

Cash-strapped California Dips Into OHV Cookie Jar. A California state assembly committee today voted to transfer up to $31 million from the state’s Off-Highway Vehicle Trust Fund to pay for non-OHV related programs in the cash-strapped state. The $31 million transfer would slash the amount in the OHV trust fund by one-half, according to Don Amador, western representative for the Blue Ribbon Coalition (BRC). The American Motorcyclist Association (AMA) earlier issued an “Action Alert” calling on California constituents to urge lawmakers to reject the transfer plan. “This is not a loan but a taking of money which will never be repaid” “The OHV trust fund is fueled by taxes paid on gasoline used by OHV recreationists and should be used to maintain OHV recreational opportunities. What right does the state assembly have to redirect funds collected directly from OHV recreation activities, and use them for any purpose other than to support OHV recreation? the AMA asserted.

    So somebody please … explain this to me . Just how in the ____ does any business ‘ Trademark ‘ the very name of the town they do business in ? As well as what part of bankrupting/financially hurting the Town will lead to bankrupting the Event eventually as well do these business men Not comprehend ?

    Do these deluded few think they’ll stay on top without the Town that gave them the businesses they so well profit from ?

    And I thought the ‘ Motor Company ‘ had the lock on trivial , inane and asinine lawsuits .

    Sturgis raising vendor fees by 8% ??????

    Screw that! Come on up to Lead to the Desperado Junction site …. we still have a few spots remaining! Oh yes, I almost forgot: Our Vendor fees have not gone up 8% …. in fact we do not charge a vendor space fee and the City of Lead only charges a $35.00 City License Fee.

    The brand name Hollister is based on a conceptional character named John M. Hollister and has nothing to do with the city of Hollister. Hollister clothing use the story of John Hollister, a renowned surfer , to sell so-cal surf inspired gear. The brand does not exploit any event in the city of Hollister, certainly not the biker event. It has nothing to do with the Sturgis trademarks story..

    FYI The Hollister name is used by Abacrombie & Fitch on their pretend surf wear . The real Abacrombie and Fitch was a one location extremely high end sporting goods store on 5th ave. in NYC years ago. They sold very expensive guns and fishing equipment for the likes of Rockerfellow and such. The current chain of A&F stores sell cheap overpriced junk cloths to kids that think it’s in.

    Jerry Berowitz of Hot Leathers wants to be the Walmart of the biker market. Push out the small vendors and take all the revenue for himself. In Daytona he advertised his shirts as official rally shirts tricking the public into thinking they were supporting the rally by buying a shirt from him.

    If the town of Sturgis is losing money on the rally why has it taken 70 years to realize this? Take away a lot of the bullshit and riders will STILL be riding the Black Hills!!!!! peace

    No disrespect meant, but in my opinion that rally simply needs to shrink. I can’t even imagine going anywhere with 500,000 of my “closest friends” and having any where near a good time. At least a few years ago all the douchebags wore the same uniform: Affliction jeans with Fluer De’ Lis embroidered on their pockets and a denim shirt with the sleeves cut off while riding a store bought chopper. I have no idea what today’s douchebag wears but there were plenty of them when I was there in 2008. To be honest I was overwhelmed. I wouldn’t go back to Sturgis unless there was a severe reduction of cops. They bus and fly cops in from everywhere, it is ridiculous. I am over all of the rallys and runs…but that is just me. I look at the photos of Sturgis from long ago and wish I was a bit older but I am afraid with all the in fighting between the city and the promoters that rally (like many others) is doomed. I’m out!

    Those guys trying to make money off the ralley through legal manipulation of trademark law should be ashamed of themselves. If they had any sense of morals, they would either give up there law suit (and go hide in a cave in shame) or give all thier fees to the city that has had the name Sturgis long before any of these guys were even born. The city throws a great event every year and they should profit from all thier real hard work. I intentianally never buy any of the SMRI stuff and none of my friends do either. I would buy “Official City of Sturgis Motorcycle Ralley” gear in a heartbeat if they sold it. That being said, SMRI would probably go after that to………………it is hard to fix stupid.

    Hollister is a coastal ranch above Gaviota State Park that is broken-up into 10 acre lots hidden within some barren foothills so they can’t be seen from the beach. The huge ranch is bordered to the north by the Bixby ranch. All pre-1800’s California and private.

    There’s several surfing points that ripple westward as the coast bends north towards Point Conception (and beyond that turbulent as the Cape of Good Hope).
    The waves move almost parallel to the coast. The only way into the “ranch” is by being a part-lot owner (20 people can “own” one lot) and have access for their family and guests. And by boat. The points are named Drakes, little Drakes, etc, etc, and the very most northern point before the “Point Conception of no return”, is Coho Point, on private Bixby ranch and only accessible by boat. It gets wild on a 10 ft. swell.
    We tied a 20 ft. Zodiac to a huge round buoy 1/4 mile outside the break (we thought) 🙂 and were almost capsized by a rogue monster wave feathering above our heads. I choked on my Tuna fish sandwich.
    Hollister ranch “changes you” everytime you lower your boat from the (free) crank wench on Gaviota pier and motor north. Anything can happen and you’re a long way from help.
    That’s why Hollister gets respect.
