Billy Lane Trial Update

Eisenmenger, attorney for custom builder Billy Lane has asked a judge to throw out blood alcohol results in his DUI manslaughter case. Lane is accused of driving drunk and killing Gerald Morelock when he hit the motorcyclist in September 2006. Lane’s attorney has filed motions asking that the blood samples not to be allowed as evidence, because Lane did not consent to a blood sample and because they believe the results were tainted by improper care of the sample. Eisenmenger contends that law enforcement authorities have failed to refrigerate the blood samples and that it may have sparked bacterial growth that led to a false high blood-alcohol level reading against his client. Eisenmenger is requesting that his expert witness, Largo toxicologist Lawrence Masten, independently re-test the samples. Prosecutor Tom Brown said the state is confident in the blood evidence.

    when there is a death due to possible intoxication, consent is not an issue. the blood is taken for further investigation.

    Lawyers stuff. First thing they do is to challenge evidence. It can and may work. But as far as I know, in Florida you don’t need consent to get blood when there is an accident with injury of death.

    everyday we awiat news of billys trial and whats going to happen to him, i have refused to comment having met billy only a few times. we work in the same state in the same business and i do like his work and his success in this business is unquestionable. i feel this is a tragedy and bad for both sides but everyday that mr. lane stays quiet and doesnt admit or deny or apologize or refute claims, (he is through his lawyers), personally i lose respect for him. i am sure he has a p.r. team telling him what to do, and say, but stand up for yourself and speak up. if you know your innocent stand up and say it to the world we are waiting billy, if you feel you did wrong admit it apologize and take your medicine and move foward. step up and do whats right..thats all i have to say. i have been holding it in for months, i didnt say he did it. or not just step up as a man and say what happened, innocent or guilty.

    Yes, the site must be very questionable and the guy who wrote this in an idiot because “non capital murder” has always been the charge. Nothing new. It’s technically the same thing as involuntarely manslaughter as far as BL is concerned.

    Rick is right. A non capital murder is a murder which is not deliberate. Of course Billy didn’t intend to kill anyone. To write that non capital murder is a new charge or a different charge against Billy is stupid.

    Morgan, I went on the site you mentioned. The guy writes that he is not a lawyer, then he explains, like a lawyer, what is non capital murder, then says he is not sure about what he said because (again) he is not a lawyer, but invites a lawyer to tell him what exactly means non capital murder. I am still laughing at so much stupidity stuffed in a few lines.

Every bike event I go to I always have a conversation with him and I don’t really know him, so it’s easy to get close to him and he will talk to anyone. You should try telling him what you think!

    Ofcoarse billy did not intendly kill a person, but he drink intendely.he was mature enough to know that DUI is risky for himself and other people on the road.
    he should be the man enough to say the truth that he was riding drunk.

    A1, you sound like you have a handle on this biz. Then you are aware that Lane’s name is a commodity.

    While stepping up sure seems like the right thing to do, if he did step up then that commodity would take a dive. Real people outside of the tragedy would suffer.

    Some outfits are shoestring and something as minor as the sale of Lane widgets might be between them and closing the doors. Extreme example? Sure it is, but it represents for why justice is served better by him keeping his yap shut and grinding out the days until he gets judged, then by him baring his soul and prematurely burdoning a bunch of other people who have some reliance on the name. Sorry if everybodies moral sensibilities are all ruffled but this is a free market society and when Lane started copyrighting stuff he became more than just a builder so the man has other obligations that demand a course of action to minimize the losses to the business. None of this excuses him from fault and punishment. I’m pointing out that his silence isn’t necessarily the act of a coward. Often things are more than they seem.

    I got no dog in this fight. What will be will be. I do have a bit of history with the law myself albeit ancient history. But it isn’t such ancient history that I forgot how slow the clock ticks while you are waiting for the gavel. It’s a fair bet that the guy who most wants the other shoe to drop is Lane himself.

    To All… Talk trash about Billy not standing up and taking responsibility, but thank/blame an attorney. The FIRST thing they will do is to tell you DO NOT discuss the case, DO NOT admit innocence or guilt. These rules apply to “Billy” the same as to any other person charged and represented by an attorney. I know Billy and my opinion of him has not changed. He has done the right thing by listening to his attorney and letting them do what they do. If you need to be pissed off about things, be pissed at the legal process.

    LOL, I know you have better things to do, so I know you will not be reading this but I have to say it….
    Geez, It always amazes me how people can talk such trash about someone when the person they are talking about isn’t standing in front of them. When I am at bike events, I take a lot of photos of bikes. Therefore, I have spent a lot of time around the Choppers Inc. setup because every time I look at his bikes I find something I didn’t see before. Never have I heard one person say anything bad to him. Where are all you haters when you have the chance to voice your opinion to the mans face.
    Maybe most of you don’t ride a motorcycle and/or go to bike events. That would explain your lack of knowledge. (Example – comparing OCC to Billy Lane doesn’t even make sense if you know anything about motorcycles and building them).
    You may now go back to watching OCC for all the knowledge YOU need.

    Glad to see you signed it Some Jackass, it seems appropriate. I assume your idea of a motorcycle is catalog shopping and having the local HD expert bolt them on for you so you can trailer your bike to the next show. Some people go beyond the catalog and get creative. My point is that some riders like to see something unique and creative, take a look at Billy’s bikes and maybe someone can show you what items you can’t find in a catalog. Cyril is a designer and spends countlesss hours designing his bikes, does he fall in the OCC realm too like Billy? Bobber, Chopper, Digger, all are different and that’s what makes it what it is… Unless you want your bike to look like all the others in a row and try and remember which one is yours. Please find a new “habit”.

    Two DrunckTwo drunks don’t make it right! Billy supposedly intoxicated passing in a no pass zone, Morelock intoxicated (No one has refuted this) riding a moped (Motorized Vehicle). Two people in the wrong place at the wrong time, we all have been told what Billy has done wrong but do we know what Morelock was doing? Did he swerve into Billy?, Where his lights working? None of us Know and will never know what really happened that night but the participants in the event, one is gone and the other will forever have to pay the price guilty or not. If you play Russian roulette long enough eventually the bullet will find the chamber. In this case who handed who the gun.

    I think I would have rather been the one pulling the trigger because in Mr. Lanes case he has to live with it guilty or not.

    I live in Virginia. Earlier this year there was an accident. An elderly couple pulled out of a restaurant and was hit by another car. The elderly couple was at fault. The eye witnesses said the guy that hit them was going the speed limit, he was not driving dangerously and appeared to do nothing wrong. He was tested and was over the legal limit. He is now in a lot of trouble.
    Even though he was driving fine, if he had not been out driving, that elderly couple may still be alive.
    Even though Mr. Morelock may have been driving okay, if he hadn’t been on the road, he might still be alive.

I doubt the man woke up that morning and said ok im going to kill someone today. It couldve happened to anyone of us. And as far as not holding a press confrence and apologizing, that would be ommision of guilt. Which is something he dosent really want to do and im sure his lawyers told him not to. Also if I or any of you were in the same situation we wouldnt hold a press confrence. So in all honsety why should he? Because hes “Billy Lane”???     A Brevard County circuit judge Wednesday agreed to hear a defense motion to retest blood samples taken from motorcycle builder Billy Lane, but she did not schedule a date for the hearing, attorneys said.

    Officials said Judge Meryl Allawas also will schedule a hearing on the state’s motion to access Lane’s medical records in its quest to convict Lane on one count of DUI manslaughter.

    Police say Lane, 37, had a blood-alcohol level of 0.19 — more than twice the legal limit — when while driving his Dodge Ram pickup he crossed a double yellow line on State Road A1A to pass several vehicles and struck 56-year-old Sebastian Inlet park ranger Gerald Morelock’s Yamaha mini-motorcycle head-on.

    Lane faces up to 15 years in prison if convicted in connection with the Sept. 4, 2006, incident. His trial is expected to begin in early 2008.

    Lane attorney Gregory Eisenmenger recently filed a motion asking Allawas to throw out Lane’s blood alcohol results on the basis that a failure by police to refrigerate the samples may have led to contamination that created a false high alcohol level.

    Eisenmenger also asked that his own toxicologist be allowed to retest the samples. Prosecutors objected Wednesday to the blood being sent to a Colorado lab rather than a local one.

    Lane’s next court date is a Nov. 6 docket sounding.

    I too have waited some time since this highly publicised accident to comment. I have met Billy Lane on occasion, and really love his bikes. I have also read his books, and watched all of the biker build-offs and BSG film. I am an avid rider. My conclusion, after months of research and listening to everyone else is this:
    Billy Lane represented himself as a rebel. So, he was nice at shows…big deal(shouldn’t he be?)He boasted about his hard biker lifestyle and considered himself a “one-percenter”, as if being one was better than just a regular biker. He revelled in his long hair(extensions, by the way) and tattoo’s. He wrote in his book, Chop Fiction, “My parents taught us(brother Warren) to be responsible for our actions”. But, as some of you have blogged, he immediately hid behind his attorney’s advice(delaying the trial), cut his hair, stopped drinking, took off all pic’s of himself on his website with alchohol. Where is this tough “one-percenter” now? Where is the taking of responsibility he so unhumbly boasted about as if he was so honorable, now? There is no doubting he crossed the double yellow and killed Gerald Morelock…By his own accord, he should plead guilty, not cut his hair, save the taxpayers money and go to trial quickly. Anything else just makes him an exposed fake..He should give refunds on the book. The lesson here is to be humble in life, and don’t take yourself too seriously. Billy wasn’t and will never be the voice of the biker. He’s just a great builder/mechanic, that’s all. And these so called “one-percenters” aren’t any better than any other biker, even those who just started riding.

    A tragic event, in a persons life, can cause someone to change dramatically.
    It can cause a chemical imbalance in the brain (depression) which can make a person change.
    I don’t know if this is why Billy has cut his hair (I don’t know how you know he had extentions. They looked very real to me and you could see them get longer through out the years) or if this is why he quit drinking.
    I have experienced tragedy in my life and it changed me drastically.

    I just read through the entire string here and am amazed at how people rip each other up for their own inability to read properly:

    Donnie and Rick were so quick to call Morgan “idiot” and “stupid” when he NEVER wrote it was any kind of NEW charge. DUH!!

    And Kate, it’s ADMISSION of guilt rather than OMISSION of guilt.

    I’ve known Billy since many years ago and they were NOT extensions! Perhaps Phil, you should take up beauty school. You seem to be more interested in cosmetology than riding.

    I invite you to consider this: If it were YOUR butt on the chopping block for a mistake you made, you might also hire a good lawyer and allow him to work the system before you went out and yapped your flap to the press. Shit, no paparazzi would even WANT to talk to any of us because we are not successful/famous bike builders. We wouldn’t even make the papers OR a blog.

    I was not aware of the fact that Mr Morelock was also intoxicated. If this is true, then it adds a little more question in my mind as to whether his ability to ride defensively was impaired. I ride and as we all know we are a moving target out there on a bike (moped) whatever!

    I hope that Billy will do what all citizens have the right to do. Let his lawyer work the system, follow his advice and keep quiet. Just because a bunch of nosey bloggers want to hear something “from the horse’s mouth”–so they can rake him over the blog some more–doesn’t mean he’s gonna’ do it.

    Why not go help our elderly neighbor lady cut her grass or some other constructive activity (Myself included)! I’m out!!!!!

    Ahh, Karen- so, with your expertise as a rider, what are your options when a three ton truck comes around a blind turn in your lane at 60mph at night?

    Mr Moreland’s ability to ride defensively is not in question- he committed no crime, nor was he charged with such after the fact; Frankly, he could have been laying passed out on the road, it does not make him culpable in any way- there is no legal requirement to “ride defensively”.

    Obviously, you and some other people on here believe that you know Billy Lane, or are his friends, or whatever. It’s understandable you want to defend him;

    Unfortunately, regardless of how much his lawyers want to tweek the system, there is no real defense for Mr. Lanes’ actions.

    Now it’s time for Billy to man up, and be held accountable.

    Look- he could do 15 years. Realistically, he’ll get two to three. So he goes and does his time- which is still better than what Mr Moreland will be doing with his time- and comes out with the real bad-boy reputation he’s always wanted. He’s not going to lose every dime (at least until he gets the legal bill), and life goes on for Mr. Lane;

    Far better than what Mr Moreland got in the deal…..

    It amazing that out of all the points I have made, the hair is the only one that anyone has responded to. So, I guess I’ll back up my comments(lol). Yes, his hair got longer. Like in one picture it is just past his shoulders, then in another, just a few months later, it is down to his ass. Believe me, he might have dreads, but he also wears extensions attached to them. When you see his hair down to his lower back, that’s with the extensions. When you see him in person, like I have many times, and he’s wearing a hat and the ponytial only goes go his shoulders, he doesn’t have the extensions in….bottom line-he’s a poser(lol).

    P.s. Yew..I am a hair expert(lol again), as mine is down to my lower back and has been my whole life. Believe me, it’s pretty hard to grow your hair that long that fast..!!!

    If I saw a 3 ton truck coming at me at night, I would hope my experience would tell me to run off the side of the road. I’d rather hit a tree, wall or lay it down than to go head on with a truck. But I refuse to ride if I have had anything to drink.
    Maybe Billy cut his hair (and I would bet you money he did not have extensions, but this is a stupid conversation!) because he wanted to change his ways, just like he quit drinking. Why should he cut his hair? It isn’t like the judge don’t already know what he looked like. The jury will see pictures from the night of the accident, so they will see his hair.
    Maybe this accident made him feel like changing some of his ways.

    He is a poser????!!!! I’m just going to believe you don’t know many bikers or much about the biker community, because you sure don’t seem to be very up to date on Billy Lane or anything else for that matter.
    Since the accident I have read articles where people such as Dave Nichols, Rick Fairless and many other people in the business support Billy. At events, I have seen him talking and socializing with Aaron Green, Paul Cox and Kendall Johnson, amoung others. Do you consider all of these people posers?
    I met Billy several times before the accident and several times since then and I can tell you he does not act like the same person. I would not be acting like the same person either. This has got to be devastating to him, just like it is for the Morelocks.

    I have not been following this case as good as I used to,though I returned to see what had developed. As usual nothing but alot of people ranting and bitching about some fool who got behind the wheel and drove drunk. The other guy supposedly had been drinking also and the losers for the first guy drill that horse in the backside all night. The simple fact is Lane crossed a DOUBLE SOLID LINE WHILE DRUNK AND BECAUSE WHO HE IS AND HIS LAWYERS ARE,HE WILL SKATE AND LIVE TO DRINK AND DRIVE MANY MORE DAYS.

    the reason the guy was riding a moped in the first place is because he probably didnt have a license because of multiple dui’s . he probably crashed and killed somebody himself. thats why he’s a drunken moped rider in the first place. everybody has seen them on the road, in everyones way riding down the road so slow. my father in laws one of em’. it was only a matter of time before he got tired of riding that moped and got in a car or truck. he probably had one in his drive way,just like all drunk moped riders do. he was destined to go back to prison or get killed any way, his family just hit the lottery by him getting killed by a rich guy. now they dont have to worry who’ll be responsible for his stuff or paying the storage place were his stuff is the next time he’s in prison or the collect phone calls that he would be making. they got lucky,they dont have to deal with him any more and there gonna get payed!

    face it.he never has been nor never will be a one percenter that is a joke…he is a bike builder using scrapped parts,damaged,etc and creates some parts with his talent, in Melbourne, up the street from my sis- in- law’s house.
    He was very nice when he walked up to me and my bike at a gas station many years ago ,and we chatted about his shop and the black bike he was on, he was very proud of it. My son has pics of him and Billy together and then theTV show hit ..ok so now out comes the 1% personna and TV made coolness. He did not need it but who would’nt love it to the hilt? GOOD TO SEE for him !!!
    Many think he may have let his fame go to his head and think nothing could ever happen. But then again If the TV show never came along most of ya all would never know him even from a gas station passing. Would this have happend? who knows?
    There is one big thing difference from the ordinary fella, and Billy Lane(forget the PERCENT mumbo jumbo,)…and that is he has money . The SYSTEM is, you are only as INNOCENT AS YOU CAN AFFORD TO BE, sad but true. I’d already be doing ALOT OF time if I had done that. Would ya’ all throw comments at me? Sure human nature kick’em when they are up and kick them when they are down. I really don’t think there is any right answer there. JUSTICE?? I’d whip the crap out of him if it were my family member killed. I have had to deal with that when my sister was killed by a careless jerk in an illegal driven dump truck. chances are I’d have to get thru several others before I ever got to Billy but I’d get there. The jerk that killed my Sister is out walking the earth in hiding from my family. Billy Lane has his own demons to deal with, judged by us or not.. Not guilty does seem arrogant but then again it is not JUSTICE, it is money and strategy.

    For those that seem to have it in their brain that drinking let alone till drunk, then driving is a mistake. You people are in utter darkness and truely need to quit hugging tree’s. For a guy with the mental capacity and talent to design and build the bikes he builds it seems Mr.Lane suffers from a lack of good judgement.
    I also drove after drinking and was caught. To me the writing was on the wall, it happened I did it I didnt bother dumping hard earned money into a lawyer as to buy a easy sentence. I went into court admited what I had done and waived a hearing to get to the sentencing. That was in 93′ I dont even think twice about drinking and driving and I do not consider that choice a NON MISTAKE.
    For the person that went on about how Mr. Lane has to protect his buisness so forth by hiding behind some legal mumbo jumbo! Thats great advice if your a sell out for the dollar. Sadly Mr.Lane will walk with some restitution to the victims family then community service, topped with some unsupervised probation. Then with his new found knowledge that drunk driving can kill he’ll write his book and cash in on how this has changed his ways lahlah. And lastly for the posers I been riding 23 years in Minnesota. I clock a good 12,000 miles a riding season. Thats roughly about 3 months in Minnesota. The avearge car driver nationly puts those miles on in a year. Now if Im fortunate to ever meet Mr.Lane I can tell you plane and simple I would have no hesitation to ask him how it feels not standing up for whats right.

    it sounds like another hollywood story. he has cash and he wont spent more than 20 minutes in jail and wont have to pay any damages

    Geez people get a grip. If it was a person who drove drunk, crossed double yellows and killed your family member, would you feel the same? The guy is a douche bag who killed a person. He is looking for lightest sentence possible when he should be using his celebrity status to make up for what he did…oh but wait, he’s famous and has been on TV… If he had never been on the Discovery Channel, people would be screaming a different tone, something to the like…” He should fry the dirty drunk!!” Pathetic how someones TV status can sway public opinion . He’s a murderer period!
